(“VideoProtects,” “we”, “us”, “our”) collects, uses, shares, and protects information about you when you interact with   any website that links to this Privacy Policy (the “Site” or the “Services”). This Privacy Policy also explains our practices when we are a service provider with respect to J. J. Information We Collect

The information we collect from you varies, depending on the way you use our Services. We collect information from or about you in the ways described below.

Information You Provide To Us

When you use our Site or Services, we collect information that you choose to share with us. We collect several types of personal information from and about you when you use our Site or Services. This information may include:

  • Name;
  • Address;
  • Identification and account information such as, identification number (e.g. employee ID, ID number, car plate number, gender, profile photo, username, and password;
  • Company name;
  • Email address;
  • Telephone number;
  • Fax number;
  • Work-related information, such as company, division, department, role, and title information;
  • Any personal information contained in any photos, media, and other files sent to us or uploaded to the VideoProtects platform; and
  • Any other information you provide to us.

As a Service Provider to our Clients

In addition, there may be instances where we are engaged to provide a service on behalf of another business or third party who has a direct relationship with you (for example, your employer) involving the collection of your personal information (the “Data Controller”). In those instances, we may need to access or otherwise process your personal information in order to provide the service that we have been engaged to perform for the Data Controller. For example, you provide us personal information directly through your use of a VideoProtects device in a vehicle you are driving, which sends the VideoProtects platform videos and data, or through your use of the VideoProtects portal, websites, customer support channels, or otherwise.

In performance of those services, we are acting in the capacity of a “data processor” or “service provider” as defined under applicable data privacy law. Where we are acting as a “data processor” or “service provider”, the privacy policy of the Data Controller (for example, of your employer), and not this Privacy Policy, applies. For example, refer to the privacy policy of the Data Controller for: (i) what personal information of yours is collected; (ii) the ways in which your personal information may be collected, used and shared; and (iii) any mechanisms available to you for exercising your rights with respect to your personal information.

An example: If you are an employee of ABC Company and driving a car that has a VideoProtects device installed in it, then you are a driver, ABC Company is our client and has full control over your personal information, and we process your personal information on ABC Company’s behalf and according to its instructions. If ABC Company gave you access to the VideoProtects portal, you can access the portal to view videos, get statistics, and take some actions, all according to your permissions as defined by ABC Company.

However, your handling of the clients’ VideoProtects devices and vehicles is subject to your relationship with your employer, our Customer. If the VideoProtects platform does not receive data from the VideoProtects device, it might not function properly. The data provided by the VideoProtects, Inc. solution to our Customer who controls your account might be incomplete or inaccurate, and that might affect your relationship, work, or compensation. Please consult with your employer regarding the potential effect of disabling or tampering with the VideoProtects device and its operations.

These are the types of personal information that we may process on our clients’ behalf:

  • Identification information and contact details of drivers and recipients of data shared via the VideoProtects platform, as entered on the VideoProtects platform, such as name, identification number, car plate number, gender, profile photo, phone numbers, and email addresses.
  • Videos from VideoProtects devices might be used to identify:
    • The vehicle;
    • The vehicle’s surroundings, which might include videos of unidentified people in the public domain, such as pedestrians and cyclists. Our clients ultimately determine the location of the VideoProtects devices and are therefore responsible for complying with applicable laws. Please do not place VideoProtects devices in the interior of private residences or any other publicly inaccessible locations or no photo zones. Videos from other private locations should also be avoided unless you’ve attained the owner’s consent; and
    • The vehicle’s interior, which might include face and body videos, expressions, behaviors, and activity within the vehicle of the driver and passengers. Gender and approximate age can also be inferred from the videos.
    • Driver smoking, driver eating, drowsiness, no seat belt, cell phone usage, eye distractions, or other driver behaviors.
  • Please be aware that the VideoProtects device and platform automatically record, and process videos taken outside and inside the vehicle if our client has configured it to do so. Any conduct within the vehicle, whether appropriate or not, legitimate or illegal (such as texting and driving or use of alcohol and drugs), might be recorded by the VideoProtects device, stored on the VideoProtects platform, and become available to our client, its permitted users, and others at our clients’ discretion. Make passengers in the vehicle aware of the VideoProtects device, about the VideoProtects solution, and their processing of personal information. Please do not record, process, transfer, or publish photos or videos in which people are identifiable without their permission, or if you have another legally justifiable reason to do so.
  • Detailed location, travel and route information, for example GPS signals (combined with a time-stamp) and other information from the VideoProtects device, which can indicate, especially in combination with the videos or other data, the location of the vehicle, its driver and passengers, and other people around the vehicle.
  • Driving data, such as speed, acceleration, deceleration (breaks), turns, stops, and crashes – which can document and indicate, especially in combination with location data and videos, the occurrence of traffic violations such as speeding, illegal parking, reckless driving, and more. We collect, and may use a third party to collect, sensory and motion data from VideoProtects devices, including, without limitation, information from its gyroscope, accelerometer, and compass, to calculate and detect various driving events and behaviors.
  • Any personal information contained in any videos, media, and other files uploaded by VideoProtects devices, clients, or users.
  • Any other personal information clients or users enter or share on the VideoProtects platform.
  • Important notice: Not all videos and data from clients’ VideoProtects devices are processed on the VideoProtects platform. Customers define on the VideoProtects platform the means and triggers for data collection for each VideoProtects device. Nevertheless, VideoProtects device data might contain the personal information such as mentioned above, which is stored locally on the VideoProtects device memory card. VideoProtects devices are owned, installed, and operated by our clients, under the clients’ sole and complete control. We take no responsibility over videos and data on the VideoProtects devices. Please contact your employer for any question regarding the use of VideoProtects devices in vehicles.

We also collect and process these types of personal information about anyone using the VideoProtects devices, platform, portal, or websites:

  • Usage, logs, analytics, and other device and technical data, including device information and identification numbers, operating system information, IP address, browser and session information, browsing history and referrals, cookies information, advertising identification numbers, language information, connectivity information, configuration information, metadata of files, and usage information (such as screen views, clicks, and usage time).

Other Information We Collect When You Use The Services

You do not need to provide personal information in order to browse or use our Site or Services. Our Site, however, collects certain information automatically about you and your use of our Site and Services that does not necessarily personally identify you, your interactions with us, and information regarding the device you use to access our Site and Services (collectively “Other Information”). This information includes:

  • Device information, such as hardware setting, web browser type and language;
  • IP address, MAC address;
  • Identifiers associated with cookies or other technologies that may uniquely identify your device or browser (e.g. device advertising ID);
  • Times you have accessed pages;
  • Pages you have viewed;
  • Searches you have conducted; and
  • Pages you visited before or after navigating to our Website.

How We Use Your Information

We use your information (both on an aggregated and on an individualized basis), to provide, analyze, administer, enhance and personalize our Site and the Services we provide to you, including our marketing of Services to you. We also use your information to communicate with you, and to operate our business. More specifically, we may use your information to:

  • Deliver our Services to you, including to provide access to our Site’s online features, complete and process your online purchases, or engage in other transactions with us;
  • Communicate with you about the Services, including to respond to your customer service requests or respond to any other inquiry or correspondence you send to us, as well as respond to you using our Live Chat feature;
  • Online advertising in all forms and channels, including targeting you and others who share similar characteristics as you (lookalikes) online on search engines, websites, apps, messaging platforms, social networking platforms, and offline;
  • Direct marketing in all forms and channels, including email, SMS, messaging, postal service, and more;
  • Provide you updates, reminders, or other informational or educational content;
  • Enable you to participate in a contest, sweepstake, promotion, or survey;
  • Enable you to participate in blogs and post reviews or testimonials. If you provide a review or testimonial, your name will be publicly posted along with the review or testimonial. Please remember that blogs, reviews, and testimonials are located in the public areas of our Site. Do not share content that you would not want others to read, save, or share;
  • Consider you for employment. When you apply for a job, we will notify you of any additional uses of your information relating to the information you provide us;
  • Analyze and improve the Site and Services, including to develop and improve products and services, and to monitor and analyze trends and usage;
  • Prevent, detect, investigate, or remediate security or other legal concerns, including fraud;
  • Protect the rights, property, or safety of us our users, or any other person, or the copyright-protected content of the Services;
  • Comply with applicable laws, regulations, or industry requirements, or respond to subpoenas or government requests;
  • Analyze and better understand how users access and use our Services, including to monitor, evaluate, and analyze trends, determine which features and portions of our Services are most popular, how they are used, and the results that are obtained;
  • Troubleshoot;
  • Generate statistics including identifying geographic regions of visitors to our Services;
  • Support our relationship with you, including to contact you about Service usage and assist you in better using our Services and to evaluate frequently asked questions;
  • Improve our Services and develop new features and Services;
  • Benchmark our Services against other products and services;
  • Respond to law enforcement requests and as required by applicable law, court orders, or governmental regulations;
  • As described to you when collecting your personal information as agreed to by you;
  • Evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of VideoProtects’ assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by VideoProtects about our customers is among the assets transferred;
  • Conduct other internal business purposes as we may determine from time to time;
  • As part of the processing activities undertaken on behalf of client, we may create derivative data that does not itself consist of personal information (such as aggregated, anonymized or de-identified data). We may also use anonymous, statistical or aggregated information collected on the VideoProtects platform, in a form that does not enable the identification of a specific user, by posting, disseminating, transmitting or otherwise communicating or making available such information to customers, vendors, partners and any other third party. For example, GPS information that we receive from your VideoProtects device may be provided to municipalities in an aggregated and/or anonymous form to help improve road safety and solve traffic problems;
  • We also process usage and analytics information, as well as some statistical and aggregate data derived from personal information, for the improvement and further development of products and solutions, and for research purposes; and
  • Fulfill any other purpose for which you provide it.

As a Service Provider to our Clients

  • The purposes for the processing of personal information with the VideoProtects solution are determined by our clients. Each client might use the VideoProtects, solution for different purposes. Such purposes might include encouraging and monitoring driving safety; protecting client assets, such as their vehicles; protecting the clients, staff, and third parties in case of accidents, legal proceedings, and insurance claims; tracking vehicles and fleet management; determining or corroborating the circumstances of a lawsuit, claim, loss or theft; preventing and detecting fraud; supervising professional drivers; route planning; traffic measurement and documentation; and more.
  • If you are a driver, we collect and use your personal information to provide our services to our clients, according to their instructions and settings, so they can achieve their respective purposes. We may use your VideoProtects device and contact details, according to clients’ instructions and settings on the portal, to communicate with you and to provide you with support and handle requests and complaints. Such interactions are performed on clients’ request, and based on the clients’ settings, or on your own requests or based on your settings in the VideoProtects device and portal.
  • Our purpose in processing personal information via the VideoProtects solution is to provide our services to the clients according to our agreements with them and applicable law. An integral part of our services to clients is the continual improvement of the VideoProtects device and platform, and therefore we also use of the data collected on VideoProtects to ensure our products and services are working as intended; to analyze, measure and understand how our services are used; to improve our products and services; to develop new features, products, and services; to protect our company, staff, clients and users, as well as drivers, passengers, and the general public; and to comply with any applicable law and assist law enforcement agencies where required under any applicable law.

How We Share Your Information

We may share information collected about you in the following situations:

  • With service providers. We share information about you with service providers to perform functions and process your data and to help provide our Services including hosting and storage providers, payment processors etc.
  • With third parties for legal or security reasons. We may share information about you if we reasonably believe that disclosing the information is needed to:
    • Comply with any valid legal process, governmental request, or applicable law, rule, or regulation;
    • Investigate, remedy, or enforce potential violations of our End User License Agreement and Terms of Use;
    • Protect the rights, property, and safety of us, our users, or others; and
    • Detect and resolve any fraud or security concerns.
  • With third parties as part of an acquisition or liquidation. If we are involved in a merger, asset sale, financing, corporate divestiture, reorganization, or acquisition of all or some portion of our business to another company, or if we undergo liquidation or bankruptcy proceedings, we may share your information in connection with such transaction or proceeding before and or after the transaction closes or the proceedings are completed.
  • We may disclose or share your personal information in connection with an employment application to verify the information you provide or in accordance with any relevant notice we provide relating to your employment application.
  • With your consent. We may share information in other ways if you give us consent or direct us to do so.
  • We may also share with third parties—such as advertisers—aggregated, or de-identified information and we do not limit our third-party providers from using, selling, licensing, distributing, or disclosing aggregated or de-identified data or using such data for their own or someone else’s marketing purposes.

As a Service Provider to our Clients

  • Our services sometime enable our clients, their users, or you, to share information, including personal information, based on your consent or other legal bases, as referenced above. Our clients, users, or you, decide about the sharing of videos and other data on the VideoProtects platform, the identity of the recipients, and the distribution of the information. For example, our client may use the VideoProtects platform to transfer videos or driving data captured on its VideoProtects devices to employees within the organization, insurance companies, law firms, law enforcement agencies, government, or municipal authorities, etc.
  • For the delivery of our services, we share all User, VideoProtects device, and VideoProtects platform data on the VideoProtects, Inc. VideoProtects platform (which includes identifiable information of Drivers, Passengers and Other People) with the Customer who is the Data Controller with respect to such data. This means that your employer has access and control over all the information we collect about you. We also share clients’ representatives contact details to all the clients’ Users and others who might need such details, to comply with any applicable law. Our Customers may select to share the information with some of their staff and other organizations and bodies, as mentioned above. As further described below, we also utilize third party processors in the provision of services, including cloud hosting providers, IT and system administration, payment processing, technical support, research and analytics, telecommunication vendors, and customer support.
  • We process your details on our servers and computers, cloud CRM services, support systems and services, billing systems, SMS gateways, Email and SMS communication, and backup systems. We may share some of your details with our staff, consultants, resellers, affiliates, and other third-party business partners for research and analysis, cooperation opportunities, joint promotions, sales, and events.
  • We use additional processors around the world for various processing activities needed for the performance of the VideoProtects, Inc. solution, our Websites, our other products and services, our operations, and our business, and share information with such processors on a need basis. Such processors include hosting and backup providers (such as Amazon Web Services), analytics providers, website technology, advertising technology, telecommunication services, media transmission services, security technology, and more. We limit the information we share with each processor based on the business need in using such processor, to protect your information while still effectively benefiting from the services of such processor.

How We Use Cookies and other Tracking Technologies

Cookies are small amounts of data which are sent to your browser from a website’s computers and stored on your computer or device. We and our research, technology, and marketing partners, affiliates, analytics, or service providers use cookies and other technologies, such as web beacons, web storage, and unique advertising identifiers, to collect information about your activity, browser, and device, specifically:

  • Remembering your preferences and allowing you to enter your user name less frequently;
  • Uniquely identifying each user session when you access the Services;
  • Compiling aggregated statistics to analyze how the Services are used;
  • Presenting you with information targeted to your interests, including our content presented on another website and across devices; and
  • Measuring the effectiveness of our Sites, Services, content, communications and advertising, including by placing web beacons (sometimes called single-pixel gifs) which emails and links have been opened by recipients.

How We Use Google Analytics

We work with service providers (including Google Analytics) who conduct analytics to help us track and understand how visitors use our Site. Google Analytics is a web analytics service provided by Google that uses cookies to help us analyze how users use our Sites. The information generated by the cookies about your use of the Services will be transmitted to and stored by Google on servers in the United States. If you access our Site through different devices, Google may associate your devices with one another. Your Access And Choices About Your Information

Access and Updates to your Information. You can access and update most of your account information on our Site by clicking on “My Account”. If you need to access, update, or delete other personal information that we may have, you can request it by changing it on “My Account”, sending a request to webinfo@jjkeller.com or calling us at 877-564-2333 to speak with a Customer Service Representative. To protect your privacy, before we give you access or let you update your information, we may ask you to verify your identity or provide additional information. We will try to update and allow you to access your information for free, but if it would require a disproportionate effort on our part, we may charge a fee. We will disclose the fee before we comply with your request. We may reject a request for a number of reasons, including, for example, that the request risks the privacy of other users, requires technical efforts that are disproportionate to the request, is repetitive, or is unlawful.

Links To Other Web Sites And Services

We are not responsible for the practices employed by websites or services linked to or from the Site or Services, including the information or content contained in such websites or services, and this policy does not apply to them. Your browsing and interaction on any third-party website or service, including those that have a link on our Site, are subject to that third party’s own rules and privacy policies. Please read the terms of such websites carefully and exercise care when providing your personally identifiable information.

Social Media Features: Our Services may include links to social media features, such as links to our Facebook page. These features may collect your IP address, which page you are visiting while using our Services, and any Facebook cookies on your device (including your Facebook ID). These services may set cookies to enable the feature to function properly. Please note that the social media services may collect this information even if you are not logged in to the relevant social media account when you are using the Services. Your interactions with these features are governed by the privacy policy of the company providing it.

Browser Do Not Track

Our Sites do not support Do Not Track (DNT) at this time. This VideoProtects CCPA Privacy Notice (commencing here and continuing for the remainder of this document), and only this VideoProtects CCPA Privacy Policy Notice, sets forth our privacy practices as required by the CCPA. When VideoProtects is not acting as a service provider

When VideoProtects is not acting as a service provider, we may collect Personal Information from you in a variety of different situations, including,
but not limited to on our website, your mobile device, through email, through the mail, and/or over the telephone, including with respect to job applicants. More specifically, VideoProtects collects the following categories of Personal Information from its Consumers, which will depend on the particular business purpose for which we collect it:

J. Inferences drawn from other personal information Preferences, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

Personal Information does not include deidentified or aggregated Consumer information.

VideoProtects obtains the categories of Personal Information listed above from the following categories of sources:

  • Directly from you. For example, from forms you complete or products and services you purchase.

How We Use Personal Information

  • Direct marketing in all forms and channels, including email, SMS, messaging, postal service, and more;
  • Provide you updates, reminders, or other informational or educational content;
  • Enable you to participate in a contest, sweepstake, promotion, or survey;
  • Enable you to participate in blogs and post reviews or testimonials. If you provide a review or testimonial, your name will be publicly posted along with the review or testimonial. Please remember that blogs, reviews, and testimonials are located in the public areas of our Site. Do not share content that you would not want others to read, save, or share;
  • Consider you for employment. When you apply for a job, we will notify you of any additional uses of your information relating to the information you provide us;
  • Analyze and improve the Site and Services, including developing and improving products and services, monitoring and analyzing trends and usage;
  • Prevent, detect, investigate, or remediate security or other legal concerns, including fraud;
  • Protect the rights, property, or safety of us our users, or any other person or the copyright-protected content of the Services;
  • Comply with applicable laws, regulations, or industry requirements, or respond to subpoenas or government requests;
  • Analyze and help us better understand how users access and use our Services, including monitoring, evaluating, and analyzing trends, which features and portions of our Services are most popular, how they are used, and the results that are obtained;

  • As described to you when collecting your personal information or as otherwise set forth in the CCPA or agreed to by you;
  • To evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of VideoProtects assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by VideoProtects about our Consumers is among the assets transferred;
  • For other internal business purposes as we may determine from time to time; and
  • Fulfill any other purpose for which you provide it.

How We Share Personal Information

VideoProtects may disclose your Personal Information to a third party for a business purpose, including to our service providers. We share your Personal Information with service providers and as otherwise set forth in our full Privacy Policy set forth above.

Disclosures of Personal Information for a Business Purpose

In the preceding twelve (12) months, VideoProtects has disclosed all categories of Personal Information for a business purpose that are displayed in the table above. In addition, we disclose your Personal Information for a business purpose to service providers and as otherwise set forth in our full Privacy Policy set forth above.

Your Consumer Rights and Choices

The CCPA provides Consumers with specific rights regarding their Personal Information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

Except in certain cases where the CCPA does not require us to do so, you have the right to request that VideoProtects disclose certain information to you about our collection and use of your Personal Information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

  • The categories of Personal Information we collected about you;
  • The categories of sources for the Personal Information we collected about you;
  • Our business or commercial purpose for collecting that Personal Information;
  • The categories of third parties with whom we share that Personal Information;
  • The specific pieces of Personal Information we collected about you; and
  • If we disclosed your Personal Information for a business purpose, a list disclosing: disclosures for a business purpose, identifying the Personal Information categories that each category of recipient obtained.

Deletion Request Rights

Except in certain cases whether the CCPA does not require us to do so or provides an exception, you have the right to request that VideoProtects delete any of your Personal Information that we collected from you and retained. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies or the CCPA does not require us to do so.

Exceptions: In accordance with the CCPA, we may deny your deletion request under certain circumstances, and will inform you of the basis for the denial, which may include, but is not limited to, if retaining the information is necessary for us or our service provider(s) to:

  • Complete the transaction for which we collected the Personal Information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you;
  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities;
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us;
  • Comply with a legal obligation; or
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.

Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to Personal Information associated with that specific account.

We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
